This is called a sanction.<\/p>\n\n\n\n<p>There are different levels of sanctions and they\u2019re decided based on the reason for the sanction. If you have had previous sanctions, this may mean new sanctions will be for a longer period.<br><br>If you claim Universal Credit as a couple and only one of you has been sanctioned, you will still see a reduction in your Universal Credit payment.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--1\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<p class=\"has-x-large-font-size\"><strong>What can I do?<\/strong><\/p>\n\n\n\n<p>If you\u2019ve been sanctioned for failing to keep to your Claimant Commitment, there are a number of things you can do.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Challenge the decision<\/strong><br>If you think the DWP have made a mistake, or you had a good reason for failing to do what was required, you can request a \u2018Mandatory Reconsideration\u2019 of the DWP\u2019s decision. There is no time limit to challenge a sanction \u2013 but it\u2019s best to do it as soon as possible. See below for more details and speak to a Benefits Adviser.<br><br><\/li>\n\n\n\n<li><strong>Apply for a Hardship Payment<\/strong><br>A hardship payment is a loan to help you out with your household expenses while you are being sanctioned. The amount you get is 60% of the Standard Allowance that applies to you &#8211; see below for more details.<br><br><\/li>\n\n\n\n<li><strong>Consider what other help you may need<\/strong><br>You may be able to apply for help from other places &#8211; see below.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-light-gray-background-color has-background\"><strong><strong>IMPORTANT:&nbsp;<\/strong>If the sanction notification says \u2018to end this sanction you need to complete this action\u2019 \u2013 then the sanction will last for as long as it takes you to complete the action required. So, if you are going to struggle to complete it, contact your Work Coach to explain why.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--2\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<p class=\"has-x-large-font-size\"><strong>What can you challenge?<\/strong><\/p>\n\n\n\n<p>Your \u2018sanction notification\u2019 (posted on your journal or, if you have been allowed to be \u2018offline\u2019, in a letter) should tell you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Why you\u2019ve received a sanction &#8211; did you have a good reason for doing what you did?<\/li>\n\n\n\n<li>The date of the \u2018failure\u2019 &#8211; were you told what could happen?<\/li>\n\n\n\n<li>The level of sanction you\u2019ve been given &#8211; have the DWP got you in the correct &#8216;conditionality group&#8217;?<\/li>\n\n\n\n<li>How long the sanction will last.<\/li>\n\n\n\n<li>How much money will be taken away from your Universal Credit payment.<\/li>\n\n\n\n<li>The date the sanction decision was made.<\/li>\n<\/ul>\n\n\n\n<p>If you think any of this isn\u2019t right, you can challenge it.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--3\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<p class=\"has-x-large-font-size\"><strong>Did you have a good reason?<\/strong><\/p>\n\n\n\n<p>A sanction should not be applied if you can show you had a good reason for acting as you did, or the DWP have not made it clear what is expected of you (and what might happen if you fail to take that action).<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-background\" style=\"background-color:#cde6e3\"><strong>Example:<\/strong><br>Kylie had an appointment at the JobCentre but was unable to attend that day because her daughter had a bad asthma attack and had to be taken out of school and rushed to A&amp;E.<br>She needs to tell the DWP as soon as possible and provide evidence. Her sanction should be overturned.<br>NB: it\u2019s always best, if possible, to ring the Jobcentre before the appointment to let them know the reason why you can&#8217;t attend.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-background\" style=\"background-color:#cde6e3\"><strong>Example:<\/strong><br>Ali was told to apply for a job at a pork butcher\u2019s \u2013 he did not apply because it would conflict with his sincerely held religious beliefs. However, he was sanctioned.<br>He should write a request for a Mandatory Reconsideration on his journal, explaining this.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-background\" style=\"background-color:#cde6e3\"><strong>Example:<\/strong><br>Barbara was sanctioned for failing to attend a day\u2019s training on writing a CV.<br>But although she got a text from her work coach telling her she had to go to the JobCentre, the text didn\u2019t say what it was about, that she had to go, or that she would be sanctioned it she didn\u2019t attend. There was nothing on her journal either. <br>As they didn\u2019t inform her properly, Barbara can challenge the sanction.&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p class=\"has-white-color has-text-color has-background\" style=\"background-color:#006666\"><strong>IMPORTANT: <\/strong>It\u2019s always best to make sure any limitations on what jobs you can look for \/ apply for are included in your Claimant Commitment. If you haven\u2019t done so, ask your Work Coach to change your commitment. You will need to accept the amended version within 7 days to avoid a sanction for failure to do so.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--4\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<p class=\"has-x-large-font-size\"><strong>Was the sanction right for the conditionality group you are in?<\/strong><\/p>\n\n\n\n<p>Check that the sanction that has been applied is the right level and period for the \u2018conditionality group\u2019 you are in, according to your circumstances.<br>See the <a href=\"https:\/\/ucpages.co.uk\/universal-credit-home-page\/who-is-uc-for-and-how-does-it-work\/conditionality-and-sanctions\/\" data-type=\"page\" data-id=\"1267\"><em>Conditionality<\/em> <\/a> page for more information on the different conditionality groups.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#cde6e3\"><strong>Example:<\/strong><br>Freddie is the primary carer of his two year old daughter, because his partner Maddy works.&nbsp; However he has been sanctioned for failing to apply for a job.<br>It appears that the DWP have made a mistake and assumed that Maddy is the primary carer of their daughter. This would mean that Freddie would be in the &#8216;all work related requirements group&#8217; and need to look for work.<br>However, as it is Freddie that is the main carer, he should be in the \u2018work preparation and work focused interviews\u2019 group. So he wouldn\u2019t need to look for or accept a job.<br>He needs to request a Mandatory Reconsideration against this decision, explaining his situation.<\/p>\n\n\n\n<p>Whether you can be sanctioned, by how much, and how long for, depends on what \u2018work related requirements group\u2019 you\u2019re in and what it is that you\u2019ve done or not done.<\/p>\n\n\n\n<p>There are four levels of sanctions:<\/p>\n\n\n\n<p>Higher, Medium, Low, Lowest.<\/p>\n\n\n\n<p><strong>Higher:<\/strong>&nbsp;If you\u2019re 18 or over, these are for a fixed period of: &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>91 days for the first time you don\u2019t keep to your Commitment<\/li>\n\n\n\n<li>182 days for the next and following times (so long as there\u2019s more than 14 days and less than a year between them)<\/li>\n<\/ul>\n\n\n\n<p><strong>Medium:<\/strong>&nbsp;These are for a fixed period of:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>28 days (or 7 days for 16\/17 year olds) for the first time you don\u2019t keep to your Commitment&nbsp;<\/li>\n\n\n\n<li>91 days (or 14 days for 16\/17 year olds) for the next and following times (so long as there\u2019s more than 14 days and less than a year between them).<\/li>\n<\/ul>\n\n\n\n<p><strong>Low:<\/strong>&nbsp;These continue until you do whatever it is you\u2019ve been sanctioned for not doing, but with an additional fixed period of<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7 extra days for the first time you don\u2019t keep to your Commitment<\/li>\n\n\n\n<li>14 extra days for the next time you do\/fail to do the same thing (so long as there\u2019s more than 14 days and less than a year between them).<\/li>\n\n\n\n<li>28 days for any following failure to comply (so long as there\u2019s more than 14 days and less than a year between them).<\/li>\n\n\n\n<li>If you\u2019re 16 or 17 there\u2019s no extra period for the first time, and 7 days for the following times.<\/li>\n<\/ul>\n\n\n\n<p><strong>Lowest<\/strong>: These are open-ended \u2013 they stop when you do whatever it was that you didn\u2019t do.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--5\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<p class=\"has-x-large-font-size\"><strong>Apply for a Hardship Payment<\/strong><\/p>\n\n\n\n<p>A hardship payment is a loan to help you out with your household expenses while you are being sanctioned. The amount you get is 60% of the Standard Allowance that applies to you.<br>See <a href=\"https:\/\/ucpages.co.uk\/universal-credit-home-page\/how-much-overview\/for-you\/\"><em>For you<\/em><\/a> for more information on the Standard Allowance.<\/p>\n\n\n\n<p>You can only get a hardship payment if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You\u2019re 18 or over, and<br><br><\/li>\n\n\n\n<li>You\u2019re struggling to meet your basic needs or the basic needs of a child or young person you\u2019re responsible for.&nbsp;&#8216;Basic needs&#8217; include accommodation, heating, food and hygiene, and<br><br><\/li>\n\n\n\n<li>You can show the JobCentre that you\u2019ve done all you can to cut down on everything except basic needs. This can include asking you to reduce any agreements to pay off debts, and <br><br><\/li>\n\n\n\n<li>You can show the JobCentre that you\u2019ve done everything reasonably possible to get money eg from friends and family, asked for extra hours at work, looked for other benefits you might be eligible for including from the council. But you won&#8217;t be expected to sell your belongings, move house, use a food bank, or get a bank loan or credit card, and<br><br><\/li>\n\n\n\n<li>In the 7 days before applying, you\u2019ve kept to all the work-related activities in your Claimant Commitment.<\/li>\n<\/ul>\n\n\n\n<p>But if the JobCentre have recorded that you have &#8216;complex needs&#8217;, then they shouldn\u2019t refuse you hardship payments.<\/p>\n\n\n\n<p class=\"has-white-color has-text-color has-background\" style=\"background-color:#006666\"><strong>IMPORTANT: <\/strong>You have to RE-APPLY for a hardship payment every month.<\/p>\n\n\n\n<p><br>After your sanction has ended, the DWP will want you to re-pay the Hardship Payment you&#8217;ve received.<br><br>They will take it back out of your Universal Credit each month until it\u2019s paid back. The most they can take is an amount equal to 25% of your Standard Allowance, or it could be less.<\/p>\n\n\n\n<p>Hardship Payments can be written off if you earn above a certain level for 6 months or more.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--6\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<p class=\"has-x-large-font-size\"><strong>Other help available<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Housing Payment \/ Discretionary Housing Payment (DHP)<\/strong><br>You might be able to get a Housing Payment \/ Discretionary Housing Payment  if you\u2019re struggling to pay your rent. You can\u2019t have one if the <em>only<\/em> reason you\u2019re struggling is because of the sanction. But if your Universal Credit has been reduced for another reason, such as the Bedroom Tax or the Benefit Cap, and you can show that you were struggling before the sanction was imposed then the council\u2019s DHP team might agree to help out with a short term grant. Contact your local Council to apply.<br><br><\/li>\n\n\n\n<li><strong>Check your benefits<\/strong><br>There might be a benefit that you didn\u2019t realise you \u2013 or someone in your family &#8211; could claim. Contact a Benefits Adviser.<br><br><\/li>\n\n\n\n<li><strong>Check your Council Tax<\/strong><br>Contact the Council to check if you should be getting a discount in your bill. And have you claimed Council Tax Support?<br><br><\/li>\n\n\n\n<li><strong>Help with utility bills<\/strong><br>Contact your gas, electricity and water suppliers to see if there\u2019s a scheme that can help you out while your income is reduced.<br><br><\/li>\n\n\n\n<li><strong>Help with budgeting<\/strong><br>You can get help with sorting out your bills and debts from StepChange, or the National DebtLine, or the Money Helper service.<br><br><\/li>\n\n\n\n<li><strong>Charities<\/strong><br>Your local council will be able to tell you if there are any local charities who can offer help.<br><br><\/li>\n\n\n\n<li><strong>Food banks<\/strong><br>If the sanction has left you and your family without food ask your social worker or doctor or health visitor, if you have one, for a referral. If you don\u2019t, contact us and we\u2019ll put you in touch with someone who can help.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>What is a sanction?
