
{"id":696,"date":"2020-02-28T14:08:43","date_gmt":"2020-02-28T14:08:43","guid":{"rendered":"http:\/\/ucpages.co.uk\/?page_id=696"},"modified":"2026-06-24T12:29:13","modified_gmt":"2026-06-24T12:29:13","slug":"the-benefit-cap","status":"publish","type":"page","link":"https:\/\/ucpages.co.uk\/?page_id=696","title":{"rendered":"The Benefit Cap"},"content":{"rendered":"\n<p>The Benefit Cap limits the overall amount of welfare benefits a \u2018working age\u2019 household can receive. <\/p>\n\n\n\n<p>The limit means that those people most likely to be affected are those with children and\/or a high rent (i.e. those who receive a high amount of welfare) who are not otherwise excluded due to their circumstances.<\/p>\n\n\n\n<p>If you are affected by the Benefit Cap, then the amount you get from Universal Credit will go down to make sure you do not get more than the welfare benefit cap limit.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--1\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-8c311d65\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-8c311d65 has-light-bg\">Who isn&#8217;t affected by the Benefit Cap?<\/h2>\n\n\n\n<p>The Benefit Cap does not apply to you (i.e. you are excluded) if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In any Assessment Period you and\/or your partner have earned income of \u00a3881 or more.<br><\/li>\n\n\n\n<li>You, your partner, or a child or young person included in your claim gets Disability Living Allowance \/ Child Disability Payment, Personal Independence Payment \/ Adult Disability Payment, Armed Forces Independent Payment, Attendance Allowance \/ Pension Age Disability Payment or Constant Attendance Allowance.<br><\/li>\n\n\n\n<li>You or your partner have been found to have a Limited Capability for Work and Work Related Activity (i.e. your award includes a LCWRA Element).<br>See &#8216;If you have health issues&#8217; for more information.<br><\/li>\n\n\n\n<li>You or your partner get Industrial Injuries Disablement Benefit.<br><\/li>\n\n\n\n<li>You or your partner get a War Disablement Pension, Armed Forces Compensation Scheme payment, or a War Widows\u2019\/Widowers\u2019 Pension.<br><\/li>\n\n\n\n<li>You or your partner are getting (or have a recognised underlying entitlement to) Carer\u2019s Allowance \/ Carer Support Payment, or have a Carer Element included when your Universal Credit award is assessed.<br>See <em><a href=\"https:\/\/ucpages.co.uk\/universal-credit-home-page\/how-much-menu\/if-you-are-a-carer\/\" data-type=\"page\" data-id=\"1540\">If you are a carer<\/a> <\/em>for more information.<br><\/li>\n\n\n\n<li>You or your partner get paid Guardian\u2019s Allowance.<br><\/li>\n\n\n\n<li>You (or you and your partner) have lost your job and you received earnings of at least \u00a3881 (or \u00a3846 before April 2026) per month in each of the previous 12 months &#8211; you will be protected for a &#8216;grace period&#8217; of 9 months.<br><br><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-black-color has-alpha-channel-opacity has-black-background-color has-background is-style-wide is-style-wide--2\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\"\/>\n\n\n\n<h2 id=\"wp-block-themeisle-blocks-advanced-heading-ce7158f3\" class=\"wp-block-themeisle-blocks-advanced-heading wp-block-themeisle-blocks-advanced-heading-ce7158f3 has-light-bg\">How do you work out if the Cap applies?<\/h2>\n\n\n\n<p>If you are not getting one of the benefits \/ in one of the situations that would exclude you from the Benefit Cap, then the Benefit Cap might reduce your Universal Credit.<\/p>\n\n\n\n<p>First the DWP will add together most of the benefits you are entitled to (including Child Benefit) and add them to the Universal Credit award to work out your monthly total welfare figure.<\/p>\n\n\n\n<p>They will then compare this total to the Benefit Cap limit that applies to you:<s><\/s><\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><strong>Situation<\/strong><\/td><td><strong>Weekly Amount<\/strong><\/td><td><strong>Monthly Amount<\/strong><\/td><\/tr><tr><td>Families with children and couples &#8211; They have had difficulty finding work, and their rent is \u00a3128.00 per week (which works out at \u00a3554.67 per month). They live outside Greater London in a 3 bedroom housing association house.<br><br>They are entitled to: Child Benefit = \u00a3272.35 per month and Universal Credit = \u00a31,877.46 per month. Their total &#8216;welfare&#8217; is \u00a32,149.81 per month. As their total welfare income is \u00a3314.81 over their benefit cap of \u00a31835 per month, their Universal Credit will be reduced by \u00a3314.81 to \u00a31,562.65.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#cde6e3\"><strong>Example:<\/strong> <br>Shaun lives in Greater London. He lives alone in a one bedroom rented flat. He is looking for work. His rent is \u00a3240 a week (which works out at \u00a31040 per month). Universal Credit = \u00a31464.90 per month. His total &#8216;welfare&#8217; is \u00a31464.90 per month. The Benefit Cap limit which applies to Shaun is \u00a31413.92 per month. His excess income is \u00a350.98 (\u00a31413.92 minus \u00a31413.92). His UC will be reduced by \u00a350.98 \u2013 his next payment will be \u00a31,413.92.<\/p>\n\n\n\n<p class=\"has-white-color has-text-color has-background\" style=\"background-color:#003333\"><strong>NOTE: <\/strong>When the DWP add your benefits together they will not include: any Childcare Costs Element in your Universal Credit award, Council Tax Support, Statutory Sick Pay, Statutory Maternity Pay, Bereavement Support Payment, Housing Payment\/Discretionary Housing Payments or Housing Benefit paid on \u2018specified accommodation\u2019 (ask a Benefits Adviser if you\u2019re not sure if this applies to you).<\/p>\n\n\n\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Benefit Cap limits the overall amount of welfare benefits a \u2018working age\u2019 household can receive.
